Lectures and questions from students.
The course seeks to analyse in depth various legal matters relating to “welfare at work”. It starts with a general theoretical framework by way of introduction to safety theory and a discussion of the relation between law and safety. After a brief historical overview of developments of Belgian regulations on safety at work and their European framework, an in-depth study will be conducted of the various sources of law with regard to safety at work such as the Welfare at Work Act, ARAB and the Codex, labour law legislation, social security regulations, etc. The following items will be examined:
- ARAB: objective, structure, characteristics, general principles and the restructuring of ARAB to the Codex on welfare at work
- Prevention and social security: prevention as a function of social security and analysis of provisions relating to prevention in occupational risk insurance
- Competence, responsibility and liability of the actors involved in welfare policy: general competence of the various actors and specific competence for employment in the same workplace; working with external enterprises and temping; special responsibilities with regard to violence, bullying and sexual harassment at work; penal and civil liability
- Organisation, status and tasks of the actors involved in welfare policy with regard to a) organisation, status and tasks of the Workplace Health and Safety Committee and b) organisation, status and tasks of internal and external services for Workplace Health and Safety
