Membership of the European Union has major consequences for public law at Member State level. Conversely the European Union legal order is itself inspired by concepts and principles that emanate from the various national legal orders. In this course these interactions are studied. After introducing a number of key concepts (such a central vs. shared administration and direct vs. indirect administration), the course looks at topical issues and developments. Substantial attention is paid to the technocratic nature of the EU and the specific challenges that this poses for administrative organization and judicial review. The course thus combines insights from EU constitutional law, EU administrative law and national (comparative) administrative law.
Some classes are organized with 'assisted teaching', meaning that a group of students does part of the teaching (e.g. discussing a particular CJEU judgement).
The textbook (K. LENAERTS and P. VAN NUFFEL (T. CORTHAUT (ed.)), EU Constitutional Law (OUP, 2021) (hardcover) of (OUP, 2022) (paperback) offers background reading for those unfamiliar with EU law, and a quick overview of some of the key subjects of the course. Main materials are, however, the PowerPoints, case law and legal doctrine posted on Canvas.
The student is able to name the main institutions, officials, concepts, procedures, rules and principles of EU administrative law and explain their interrelationship in a specific case.
The student has insight in and can demonstrate the relationship (interdependency) between EU and domestic (Member State) administrative law.
The student can report on and critically assess developments in EU administrative law, especially recent case law of the CJEU.
The student can carry out research, in group, on topical issues of European administrative law and report on his findings in a thorough paper.
