Course Content

This course aims to provide a historical overview of labour law and its place in the modern societal context along with a solid substantive understanding of the main components of this specific field of law. This includes the regulations governing the organisation of the labour market (including employment policy), the autonomy of labour law with a focus on its scope and specific sources, individual employment contracts, collective labour law, and social enforcement law, including topics such as criminal enforcement, prescription and waiver of rights.

The introduction focuses on the specificity of labour law, its historical development and on a number of general issues such as the characteristics of labour law, its relation with the other fields of law and the hierarchy of legal norms.

Collective labour law contains the following three key components: collective bargaining agreements, industrial action and (public) corporate organisation.

The doctrine of individual labour relations deals with the organisation of employment under the authority of an employer starting from the stage of job seeking up until the termination of the employment.

As labour law shows many interfaces with other fields of law (e.g. constitutional and administrative law, criminal (procedural) law, civil (procedural) law, European and international law) to which reference must be made on a regular basis, students are required to build on competences acquired in other courses. The course also requires the student to observe current developments in labour law, as this is a highly evolving area of law.

  • The student is able to analyse and solve a labour law case, taking into account the applicable legislation and jurisprudence.

The final grade is composed based on the following categories:
