Algemene competenties

The learning outcomes of the module are:

1. Knowledge: The student will be able to show knowledge of:

  • historical development of Common Law;
  • basic principles of Common Law in England and Wales, with occasional reference to other common law legal systems;
  • the legal system and legal institutions of England and Wales;
  • the functioning of the precedent system;
  • the civil law and criminal law system in England and Wales;
  • influence of Common Law on European and international law;
  • influence of Common Law on legal systems beyond England and Wales;
  • legal terminology in Common Law;

2. Intellectual skills: The student will be able to:

  • apply the acquired knowledge to analyse research questions
  • determine the relevant issues in research questions
  • synthesise information from a number of primary and secondary international legal sources to appreciate their relative value and authority, and to achieve an advanced and sophisticated knowledge and understanding of common law legal systems;

Additional information about the examination

You will receive a single grade for this course. That grade will be arrived at based on two elements – a written briefing note which you will submit in advance, and an oral exam during which you will be asked questions on aspects of the course, and possibly on your briefing note. You will not be given time to prepare.

Assessment methods
The module is assessed based on a briefing note on a chosen subject submitted in advance of the oral, and the oral. The exact submission date will be given during the lectures. In the first semester that submission date will be before the start of the Winter Holiday. 

Each student will be assessed on their ability to explain and argue the content of their briefing note during the oral as well as on their answers to other questions which are designed to illicit whether they have an understanding of the various topics covered in class. The grade is based on both the briefing document and the performance during the oral, there are no separately graded elements.

Assessment criteria
A student gaining a mark of distinction will have provided an insightful briefing note which will include an opinion on the topic analysed, and will have answered the oral questions in a manner which demonstrates an understanding of the legal issues at hand.  They will be able to substantiate their arguments with convincing legal arguments and authorities.

A student that meets the pass mark will have provided a briefing note and answers to questions which demonstrate adequate ability to understand and engage with the rules and principles and knowledge of more than one topic covered in the course. They will be able to show an understanding of basic links within a common law legal system and will be able to explain how they relate to law in general.

A student that fails this module will be unable to show basic knowledge of the rules and principles; such a student will not be able to answer legal questions relevant to the module or will depend on weak generalisation and undeveloped argumentations.
