Course Content

This study builds further on some parts of the study of criminal law and criminal procedure.
The most important offences from Book II of the Belgian Criminal Code, in the order of the articles, are studied.

Focus lies on the elements of the offences and the problems of sentencing and prosecution. The major case law and doctrine is explained.

These offences are studied:

  1. Illegal arrest and entering property, illegal act by civil servants
  2. Forgery and use of false instruments and forgery in ICT.
  3. Embezzlement, Conflict of interest, Bribery by public officials and civil servants
  4. Violence and insult against officials
  5. Association of criminals, criminal organizations
  6. Sexual crimes
  7. Non respect of judgements regarding alimony
  8. Assaults against the physical integrity, torture
  9. Non assistance to persons,human trafficking, stalking
  10. Crimes against the fame and honour of persons
  11. Theft and extortion
  12. Abuse of trust, fraud
  13. Handling stolen goods

Learning Outcomes

General competences

  • The student can describe and analyze the rules of criminal law, both the offences as the problems of general criminal law, sentencing and prosecution, in a throughout manner by using the legal text.
  • The student can independently describe and analyze the elements of the offences of Part II of the Belgian Criminal Code by using the legal text.
  • The student can recognize the general problems of criminal law or criminal procedure.
  • The student can independently apply the general principles of criminal law and procedure on the special part (offences).
  • The student can prove the social impact of the special criminal law.
  • The student can indicate the evolution of the law on the basis of the different views in jurisprudence and doctrine.
  • The student can indicate the different qualifications listed in the Criminal Code on the level of a beginning professional.

Grading

The final grade is composed based on the following categories:
Oral Exam determines 100% of the final mark.

Within the Oral Exam category, the following assignments need to be completed:

  • Oral Exam with a relative weight of 100 which comprises 100% of the final mark.

Additional info regarding evaluation

Oral exam with possibility of open book preparation. Questions are aimed at insight.

The student is considered to know the rules ofthe general part of the criminal law and of the criminal procedure (bachelor level)

Specific provisions regarding the use of tools and instruments during exams:

1. The "Additional regulations regarding the use of tools during exams" applies except the exceptions listed below.

2. Exception to art. 3, § 1, first and second al.: With the exception of the Larcier-codes, the use of annotated codes (eg TWS, Keure annotated code, Larcier Law & Interpretation) or printing annotated texts from databases (eg Jura) are not allowed.

3. Special provision article art. 3, § 1, second and third al.: The use of material for indexing (post-it etc.) and the use of fluorescent indications is admitted to find the offences more quickly. This should however not go so far that the various elements of the offences are somehow indicated (eg fluorescent highlighting, underlining, numbering, etc.).
