Course Content

This course gives a thorough overview of the Belgian law of obligations. The lectures will deal with these topics mainly from a theoretical perspective. However, in order to illustrate the application of these  rules, also fictional examples and actual jurisprudence will be discussed.

The course deals with the following topics:

  • The notion of obligation and the different types of obligations
  • The notion of contract and the different types of contracts
  • The basic principles of contract law
  • The conclusion of a contract
  • The obligations of the contracting parties
  • The influence of contractual obligations vis-à-vis third parties
  • The obligations rising out of unilateral legal acts
  • The extra-contractual obligations
  • The elements of extra)contractual liability
  • The modalities of obligations
  • The transfer of obligations
  • The expiration of obligations
  • Proof of obligations
  • The influence of the supranational legal order on the law of obligations

  • The student has a thorough knowledge of the basic rules of Belgian Law of obligations. The student also has insight into the coherence of these rules and an understanding of it's societal relevance. 
  • The sudent is able to use professional legal terminology. 
  • The student has an historical understanding of the development of this field of law. Therefore, the student not only has insight into the rules of contemporary law but also in its dynamic nature. 
  • The student is able to solve a simple case in this field in a proficient manner and with the use of statutory law.

The final grade is composed based on the following categories:
Written Exam determines 100% of the final mark.

Within the Written Exam category, the following assignments need to be completed:

  • Written Exam with a relative weight of 100 which comprises 100% of the final mark.
