Course Content

This course provides an overview of the Belgian criminal law as it can be found in book I of the Code of Criminal Law.

In this course, the Belgian criminal law is approached from four key concepts: the criminal law (the application of criminal law in time, space and towards the person), the offence (the material and moral element and the grounds of justification), the perpetrator (natural persons and legal persons, the punishable participation and the grounds of exclusion of guilt, the grounds of irresponsibility and the grounds of excuse) and the sanctions (the notion and the conditions of application of the different punishments, the determination of the punishment and the other civil consequences of the offence).

Learning Outcomes

General competencies

  1.  The students obtain a thorough knowledge of and insight in the reasoning of a criminal judge: when do we speak of a binding criminal law, a crime, a punishable perpetrator and a punishment?
  2.  The students are able to make connections between the various steps of this reasoning, so that the student not only acquires knowledge of the subject matter, but also understands the internal coherence between these steps.
  3.  The students obtain an insight in the evolving nature of the criminal law as a policy instrument (e.g. the successive legislation concerning the mentally ill).
  4.  The students obtain the essential skills to take the steps of this reasoning themselves and to solve problems concerning sentencing (e.g. the mitigating circumstances, recidivism and concurrence of offences).
  5.  The students obtain an understanding of the role of criminal law in society and the legal protection principles that must be respected when applying criminal law.

Grading

The final grade is composed based on the following categories:
Written Exam determines 100% of the final mark.

Within the Written Exam category, the following assignments need to be completed:

  • Written Multiple Choice with a relative weight of 3 which comprises 75% of the final mark.
  • Written Case Study with a relative weight of 1 which comprises 25% of the final mark.

Additional info regarding evaluation

Written exam consisting of, on the one hand 15 multiple choice questions concerning the theoretical aspects (15 points, one point for each multiple choice question) and on the other hand a case with 5 open questions (e.g. When is someone eligible for a conditional release, or when does a person acquires the state of recidivism) (5 points, one point for each open question). The use of the not-annotated criminal code is permitted during the entire exam.
